The following Terms and Conditions and any other rules including any guidelines and future modifications posted on this website (collectively the "Terms") constitute a binding agreement between EASTEAM and you, the visitor, governing your access and use of all content, software, functionalities and services including the purchase of products on the EASTEAM website accessed through the URL www.easteamny.com and any related micro-sites.

Please read these Terms and Conditions carefully and make sure that you understand them before using the Services. EASTEAM provides the Services for your personal use. By using the Services, you agree to these Terms. All products' prices are as indicated on the Services and are in U.S. dollars. They are subject to change without notice and do not include sales tax or delivery costs, which you agree to pay upon ordering.

When placing an order, you affirm that the information provided is accurate, complete, and up-to-date. EASTEAM reserves the right to refuse or cancel any order at its discretion. The available payment methods on our platform must be used for payments. By submitting your payment details, you grant us permission to charge the applicable amount for your order.

9. BUYING PRODUCTS ON OUR WEBSITE

You are not required to create an account before placing an order with EASTEAM. For your convenience, an account will be automatically created for you using the email address provided at checkout. This allows you to easily access your order history, track shipments, update your shipping address, and manage other preferences.

While account creation is optional prior to purchase, we strongly encourage customers to activate and utilize their EASTEAM account for a more personalized and seamless shopping experience.

Customers are responsible for ensuring that the information they provide during checkout—such as email address, shipping details, and contact information—is accurate, complete, and current. EASTEAM reserves the right to refuse service, cancel orders, or restrict access to user accounts at our sole discretion if inaccurate information is detected or if any misuse of our platform is suspected.

After you place an order, we will send an email confirming its receipt. Your order can be accepted only after we receive full payment for the goods you ordered. Once we receive your payment and confirm the product's availability, we will send you an email confirming your order has been accepted and dispatched. Our acceptance of your order forms a legally binding contract between us.

12. Shipping and Delivery

We are committed to processing and dispatching orders with speed and efficiency. However, please note that delivery times may vary based on your location and other external factors that are beyond our control. We cannot be held accountable for any delays, damages, or losses that occur during transit. Please be aware that any customs duties, taxes, or import fees incurred will be the sole responsibility of the purchaser.

13. Lost or Stolen Package

At EASTEAM, we take every precaution to ensure your order is delivered safely and on time. However, once a package has been marked as "Delivered" by the carrier, EASTEAM is no longer responsible for any lost, misplaced, or stolen items.

If your tracking information indicates that your order has been delivered, but you have not received it, we recommend the following steps:

  1. Verify the Delivery Address – Double-check the shipping address on your confirmation email to ensure it was entered correctly.

  2. Check With Household Members or Neighbors – In some cases, packages may be received by others at your address or nearby.

  3. Inspect Your Surroundings – Couriers may leave packages in secure, less-visible areas such as porches, mailrooms, lobbies, garages, or behind planters.

If you are still unable to locate the package, please contact us at support@easteamny.com within 5 business days of the delivery scan. We will assist you in filing a claim with the shipping carrier and provide any relevant documentation or support needed during the claims process.

Please note:

  • Claims must be submitted within the time frame set by the carrier (typically within 7–15 days of the marked delivery date).

  • The resolution of the claim, including any possible compensation, will be subject to the carrier’s investigation outcome.

  • EASTEAM is not liable for delays caused by the carrier or misdeliveries due to incorrectly provided shipping information.

14. Returns Policy

Returned Products must conform to our returns policy below.

You have a legal obligation to take reasonable care of the products while they are in your possession, and you must return them in the same condition in which you receive them (except to the extent reasonably necessary to examine them). This includes the following guidelines:

  • Products should be returned unworn (other than to try them on), unwashed, undamaged and unused with their original tags
  • Footwear and accessories should be returned in the original boxes provided and inside a protective shipping box
  • If the Product comes with a security tag this should be left on
  • Lingerie and swimwear must only be tried on over your own lingerie or swimwear garments

If you fail to comply with the above obligations (including the conditions of return), we may deduct from the refund an amount to reflect the diminished value of the Product(s) up to the full price of the Product(s).

We recommend that you return Products in their original packaging to ensure the necessary protection when in transit. Instructions for the return of the Product(s) will be included with the delivery package. When canceling a purchase and returning Products to us you have this option provides below:

Depending on where you live, you will be refunded the full credit for the Product(s) (subject to our Returns Policy) but will be liable for the organization and cost of returning the Product(s) to us.

Except in relation to certain types of Products (as set out above), you may cancel a contract at any time before your order is delivered and up to 14 days afterwards, beginning on the day after you received the Products ("cooling-off period").

To cancel a Contract, you must clearly inform us, preferably:

If you cancel an order (or part of an order) during the cooling off period, you must return the Product(s) within 14 days after the day on which you notify us of the cancellation and comply with the Returns Policy.

If you cancel a Contract between us within the 14 day cooling-off period (see above), we will process the refund due to you as soon as possible and, in any case within 30 days after the day on which we receive the Product(s) back or if earlier, the day on which we receive evidence that you have returned the Product(s) to our returns address.

We will refund the price of the Product(s) in full as store credit (subject to any deduction we are entitled to make due to your use of or damage to the Product(s)), excluding the cost of standard delivery. However, we will not refund your cost of returning the Product(s) to us, and you are responsible for those costs. We will refund any money received from you using our store credit system.

15. Affiliate Program Terms

EASTEAM offers an Affiliate Program designed to reward content creators, influencers, and ambassadors who drive qualified sales through tracked referral links or coupon codes. Participation in the Affiliate Program is subject to the following terms:

Eligibility & Enrollment
 To join, participants must apply and be approved by EASTEAM. We reserve the right to accept or decline applications at our sole discretion without obligation to provide justification.

Commission & Performance Tiers

Affiliates earn a commission on net referred sales (excluding returns, shipping, or taxes) made through their unique links or coupon codes. Commission rates may vary based on tier, campaign, or promotional period. EASTEAM reserves the right to modify rates or performance requirements at any time with prior notice.

Tracking & Attribution
 Affiliate links are tracked via browser cookies that remain active for 30 days. Commissions are credited when purchases are completed within this tracking period. EASTEAM is not responsible for lost tracking due to third-party interference, browser settings, or customer behavior.

Payout & Thresholds

Commissions are paid monthly via the payment method selected by the affiliate. Minimum payout thresholds may apply. Affiliates are responsible for submitting accurate tax and payment details.

Content Usage & Buyout Rights
 By participating in the Affiliate Program, you agree that all content created in collaboration with or in promotion of EASTEAM—including but not limited to photos, videos, testimonials, and captions—grants EASTEAM full commercial rights and a lifetime global buyout. EASTEAM may use this content without limitation across all media and channels, including advertising, paid media, packaging, retail display, email, website, and social media.


You waive any claim to additional compensation for the reuse or redistribution of such content by EASTEAM or its partners and acknowledge that the brand retains full promotional rights to all submitted or publicly shared materials.

Use of Brand & Assets
 Affiliates must represent the EASTEAM brand respectfully and truthfully. Any use of logos, images, or brand marks must comply with EASTEAM’s guidelines. Misleading claims, false advertising, or brand impersonation will result in immediate removal from the program.

Termination
 EASTEAM may remove affiliates from the program at any time, with or without cause. Grounds for removal may include non-compliance, unethical conduct, inactivity, or brand misrepresentation.

16. Restrictions on Use

By utilizing our Services, you agree to refrain from:

  • Replicating, modifying, reusing, uploading, posting, transmitting, selling, licensing, renting, lending, or otherwise distributing any elements of the Services or any materials obtained from or through the Services. This also includes decompiling, reverse-engineering, disassembling, or otherwise attempting to source code from our Services, or creating derivative works based on them;
  • Misrepresenting or misdirecting the source, sponsorship, or affiliation of the Services or any materials within by using "framing" techniques or similar methods;

  • Overloading the Services with an unreasonable or disproportionately large load;

EASTEAM provides this Site and all information, content, materials, products, and services on an "AS IS" and "AS AVAILABLE" basis, unless otherwise stated in writing. EASTEAM does not make any express or implied warranties regarding the operation of this site, its content, or any products or services made available through it, unless explicitly stated. Your use of this site is solely at your own risk.

EASTEAM disclaims all warranties, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose, to the fullest extent permissible by applicable law. EASTEAM does not guarantee that the site, its servers, or any emails sent from EASTEAM are free from viruses or other harmful components.   • Governing Law and Jurisdiction: These terms and conditions, and any disputes or claims arising out of or relating to these terms and conditions or the use of the EASTEAM platform, shall be governed by and construed in accordance with the laws of the State of New York, excluding its conflicts of law principles. Any legal action, suit, or proceeding arising from or relating to these terms and conditions or the use of the EASTEAM platform shall be brought exclusively in the state or federal courts located in the City of New York, State of New York. By using the EASTEAM platform, you hereby consent to the personal jurisdiction and venue of such courts and waive any objections to the exercise of jurisdiction over you by such courts. This provision ensures that any legal disputes or claims arising from the terms and conditions or the use of the EASTEAM platform will be resolved in the courts located in New York City, New York, under the applicable laws of the State of New York.
